5. Descriptions & Measuring
5.1 The product information and photographs on Our website are provided for illustrative purposes only and We do not warrant that they are accurate. The samples viewed at survey are current and a better reflection of the finished product You will receive.
5.2 As the Goods which You order are manufactured to the measurements we take at the survey, it is important that they are accurate. We will take care to ensure this but will not accept any responsibility if these measurements change after We have measured (e.g. You have changed the windows, re-plastered, decorated etc). We will take pictures of each window as We measure, as evidence.
5.3 We will try to ensure that the Goods supplied match, in every respect, any description We have given on Your quotation. Any minor or immaterial variation, change in colour or pattern, between the sample or description, and the Goods delivered shall not entitle You to reject the Goods nor to claim any compensation for such variation or change.
5.4 We do not warrant as to the fitness of the Goods supplied for any purpose other than that of an internal window or doorway dressing, other installations and uses are at Your risk.
5.5 Tolerance levels of shutter size specifications are plus or minus 2mm, and the product will not be considered defective if falling within that range. Warp on any vertical or horizontal component part shall not exceed 1mm per 300mm and may not be considered defective if within this range.
5.6 We recommend that Goods be ordered within our normal specification range, We may at Your request exceed the limitation but cannot accept responsibility for any problem that may result, nor will the Goods be warranted.
6. Fitting Specifications
6.1 Often we use our unique fitting method called D1 Fixings. This method suspends the frame in your recess under pressure and leaves a shadow gap around the edge of the frame. This gap can vary in size due to a number of factors, such as out of level windows or tiling in the window. We will endeavour to inform You of this during Your survey but large or uneven gaps shall not entitle You to reject the Goods nor to claim any compensation.
6.2 If D1 fixings are used, an expanding tape will be fitted to fill the shadow gap around the frame. This tape can take several hours, or up to a week, to fully expand, depending on a number of factors such as temperature. If after a week the tape has not fully expanded, we will arrange to replace the tape for you at no charge.
6.3 If D1 Fixings can’t be used, We will explain how the Goods will be installed at the survey and endeavour record this on your design form.
6.4 If there are any compromises to the fitting of the Goods, they will be noted on Your design form. By making payment You are confirming Your understanding and authority to proceed based on the details noted on the design form.
6.5 The top and bottom rails, above and below the louvres, can vary in height between 70mm to 130mm. We take care to provide the smallest rails possible for the panel height but larger rails may be unavoidable. We will endeavour to inform You of any larger rails but this shall not entitle You to reject the Goods nor to claim any compensation.
7. Fitting Dates
7.1 You will be provided with an estimate fitting date once Your order has been placed. This is an estimated date based on projected shipping times and is not a guarantee of when Your Goods will arrive or be fitted.
7.2. Once we have received notification of a delivery date for Your Goods, we will confirm a fitting date with you as close to Your estimated date as possible. If this confirmed fitting date is not suitable, We will provide You with the next availability.
8. Warranty & Faulty Goods
8.1 The Goods are covered under the manufacturer’s warranty from the date of order. The length of the warranty period differs for each range:
- Elite Wood = 3 years
- Standard Wood = 10 years
- Basic Wood = 5 years
- Faux Wood = 10 years
For all ranges:
- Colour fastness is warrantied for 5 years
- Stainless steel hardware is warrantied for 5 years
- All other hardware is warrantied for 1 year
8.2: Faults are benchmarked at a visible distance of 1 metre with the naked eye.
8.3 All our Shutters are handmade and therefore will display characteristics of a handmade process. In particular small knots and grain patterns are natural and not considered imperfections.
8.4 Uneven light gaps between louvres are unavoidable and the shutters on their own are not a blackout solution.
8.5 Our Goods are not guaranteed against extreme damp or variable conditions.
8.6 If any parts of the Goods are faulty, We will arrange for the supply of like-for-like replacement parts and return to fit them for You, free of charge.
8.7 If any parts of the Goods are subject to accidental damage after installation and We have left the premises, the replacement parts will be chargeable. Any additional visits to inspect damage or fit replacement parts may be chargeable at Our discretion.
8.8 Replacement parts are subject to the standard shipping times, usually arriving in 8-10 weeks but can vary throughout the year.
8.9 No liability shall arise unless the invoice has been paid in full.
8.10 Except where You are a consumer, We will not be liable for any indirect or consequential loss or damage or loss of profits arising out of Our failure to supply the Goods to You.
8.11 Except where You are acting as a consumer, all other guaranties, conditions and terms relating to fitness for purpose, satisfactory quality or condition of the Goods whether implied by statute or common law or otherwise are excluded to the fullest extent of the law.
9. Representations
No descriptions, recommendation, or statement contained in any brochure, price list, advertisement, communication, web pages or by any employee or agent of Chichester Shutters Ltd shall be interpreted so as to vary, override or enlarge in any way any of these terms and conditions.
10. Validity
If any part of these terms and conditions is unenforceable including any provision in which We exclude Our liability to You the enforceability of any other part of these conditions will not be affected.
11. Third Party Rights
